These Terms of Service ("Terms") govern your access to and use of HeroBrowser, a browser game available at herobrowser.app (the "Service"). By creating an account, signing in, or playing as a guest, you agree to these Terms.

1. Who We Are

2. Eligibility

You must have the legal capacity to accept these Terms, or the consent of a parent or guardian, to use the Service. [PLACEHOLDER: confirm a minimum age with counsel — the Service does not currently verify age at sign-up.]

3. Your Account

You can play three ways: as a guest, whose progress is stored only in your own browser and never reaches our servers; by signing in with Google; or by registering with an email address and password. You are responsible for keeping your sign-in credentials confidential and for all activity under your account. Guest progress does not transfer automatically to a signed-in account.

4. Virtual Currency — Gold Diamonds

Gold Diamonds are the Service's premium virtual currency. Some Gold Diamonds are earned free through in-game milestones; others can be purchased with real money. Regardless of how you obtained them:

  • Gold Diamonds are a limited, personal, non-transferable, revocable licence to use a feature of the Service. They are not property, are not a currency, and carry no monetary value.
  • Gold Diamonds cannot be redeemed, exchanged, or cashed out for real money or anything of real-world value, and cannot be transferred outside the Service except through the Trading Post described below.
  • We may change what Gold Diamonds can be spent on, how they are earned, and their price, at any time, and may suspend or revoke your licence to any Gold Diamonds or virtual item if you violate these Terms.

5. Random Rewards (Loot Boxes)

Certain content — currently the Hero Vault, a chance-based reward mechanic sometimes called a "gacha" or "loot box" — grants a random item from a disclosed pool in exchange for Gold Diamonds, pull tickets, or Red Diamonds earned in-game. The following applies whenever this feature is active for your account:

  • the odds of every possible outcome are disclosed to you before you pull, on the same screen as the purchase button;
  • every apex-rarity item obtainable this way also has a direct, guaranteed purchase price — nobody is forced to rely on chance to obtain it;
  • a pull can be funded with pull tickets or Red Diamonds earned by playing, not only with a real-money purchase;
  • items obtained this way are virtual items under section 4 above — they have no cash value and cannot be redeemed for real money;
  • availability may be restricted in your country or region, in which case the feature is disabled for your account regardless of your Gold Diamond balance; and
  • you must be 18 or older to make any real-money purchase, including one that funds this feature.

6. Trading Post and Player Gifts

The Trading Post lets players list and buy certain gear and materials from one another using Gold Diamonds. Trades are between the players involved; we are not a party to any individual trade beyond operating the platform it runs on. We may cancel, reverse, or void a listing or trade we reasonably believe resulted from a bug, an exploit, or fraud. Nothing tradeable on the Trading Post carries any guaranteed real-world value.

You may also send an eligible virtual item from your inventory to another player as a gift, through the in-game mailbox, by entering that player's Invite code. Any piece of gear in your inventory can be gifted. A gift leaves your inventory when you send it, can be recalled by you only until the recipient claims it, and is final once claimed. We may limit how many gifts an account can send, restrict gifting to accounts that have reached a minimum floor, suspend the feature at any time, and cancel or reverse a gift we reasonably believe resulted from a bug, an exploit, or fraud.

6.1 Selling Virtual Items Outside the Service

You may agree with another player, outside the Service, to exchange a virtual item for real money or anything else of value, and deliver that item using the gift feature described in section 6. If you do:

  • the arrangement is solely between you and the other player. We are not a party to it, we do not process, hold, guarantee, or refund any payment, and we cannot verify that either side has performed;
  • we will not mediate or decide disputes about such an arrangement, reverse or recall a gift that has been claimed, restore an item you gave away, or compensate either side if the other does not perform;
  • the item remains a virtual item licensed under section 4: it has no guaranteed real-world value, it may change or be removed as the game evolves, and section 6 still allows us to cancel or reverse a gift that resulted from a bug, an exploit, or fraud;
  • you are responsible for any tax, reporting, or other legal obligation the arrangement creates in your country, and for complying with the terms of any payment service you use;
  • you deal with the other player at your own risk. We do not vet other players and give no assurance about them; and
  • this section covers virtual items only. Your account and your Gold Diamonds remain non-transferable under sections 3, 4, and 7.

7. Prohibited Conduct

You agree not to:

  • cheat, exploit a bug or unintended interaction for personal gain instead of reporting it;
  • use bots, scripts, or automation against the Service outside its own built-in auto-battle system, or otherwise interact with our API other than through the Service as provided;
  • reverse-engineer, decompile, or attempt to extract the source of the Service beyond what applicable law expressly permits;
  • create or use multiple accounts to duplicate one-time milestone rewards;
  • sell, rent, or transfer your account, or any Gold Diamonds, for real money or anything of value outside the Service (a virtual item may be sold outside the Service only as described in section 6.1);
  • dispute a legitimate charge with your bank instead of contacting us first (see Refunds & Right of Withdrawal); or
  • harass, impersonate, or abuse other players or our staff.

8. Enforcement & Account Termination

We may warn, suspend, or terminate an account that violates these Terms. Where we terminate an account for a violation of section 7, any remaining Gold Diamonds or virtual items on that account are forfeited without refund, except where a refund is separately required by law or already in progress. Termination does not cancel a purchase refund or chargeback outcome that has already been decided.

9. Intellectual Property

The Service, including its code, art, audio, and design, belongs to [PLACEHOLDER: registered company name] or its licensors. These Terms do not transfer any of that ownership to you; they only grant you a licence to play the Service as intended.

10. Disclaimers

The Service is provided "as is" and "as available." We do not guarantee it will be uninterrupted, error-free, or available at all times, and we may change, suspend, or discontinue any part of it, including Gold Diamonds or the Trading Post, at any time.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the twelve months before the claim arose [PLACEHOLDER: confirm this cap and any carve-outs with counsel]. Nothing in these Terms limits liability that cannot be limited under mandatory law, including liability for fraud or for a consumer's non-waivable statutory rights.

12. Governing Law & Disputes
